Plain summary

1. This site is a pre-launch waitlist for a mobile product called gamedai. There is no app yet, no purchase, and no account — only an email signup and an optional product suggestion form.
2. By joining the waitlist, you agree to receive a confirmation email and infrequent launch updates. Reply with the word "remove" at any time to stop them.
3. The site is provided as is, without warranties. Don't scrape it, don't probe it, and don't try to abuse it. If a dispute comes up, we'll try to work it out informally first; the formal process will be set when the entity is formed.

The service today

What you can do on this site today:

1. Read the marketing pages describing what gamedai is intended to be when it launches.
2. Listen to short audio samples that preview the product's voice and style.
3. Submit your email and (optionally) your favorite NFL team to join the waitlist.
4. Submit a free-text product suggestion or pilot idea through the suggestion form.

What you cannot do on this site today:

1. There is no mobile app published yet. Anything you read on the site about the app describes a future product. Features may change, slip, or be cut entirely between now and launch.
2. There is no account, no login, and no password. Joining the waitlist does not create an account.
3. There is no purchase, subscription, or checkout. No money changes hands. If pricing or plan information appears on the site, it is illustrative and is not an offer.
4. There is no premium tier, no paid early access, and no way to upgrade. If we ever introduce one, separate terms will apply.

The site is provided on an "as is" and "as available" basis. We may change, pause, or shut it down at any time without notice.

Eligibility

To use this site, you must be at least 13 years old. By joining the waitlist or submitting a suggestion, you confirm that you are 13 or older.

If you are using the site on behalf of an organization, you confirm that you have authority to do so, and references to "you" in these terms include both you personally and that organization.

We rely on the information you give us being truthful. If you sign up with an email that isn't yours, you may not receive the confirmation, and we may delete the record without notice.

The mobile product, when it ships, may have a higher minimum age in some regions or on some app stores (for example, 16+ in parts of the EU, or 17+ on the App Store). Those rules will be set with the app and may be stricter than what is here.

Acceptable use

The site is small and simple, and we expect normal, good-faith use. The following are not allowed:

1. Spam: submitting the form repeatedly, using disposable inboxes to inflate signup counts, or signing up other people without their consent.
2. Scraping: automated retrieval of pages, audio samples, or any content for the purpose of harvesting copy, building competing datasets, training machine-learning models, or republishing.
3. Security probing: vulnerability scanning, penetration testing, fuzzing, brute-force attempts, or any activity intended to circumvent rate limits or access controls without our prior written permission. If you want to report a vulnerability, email hello@gamedai.app first.
4. Reverse engineering or interfering with the site's normal operation: tampering with client-side code in a way that affects other users, attempting to inject content, or running denial-of-service activity.
5. Misrepresentation: pretending to be someone else, impersonating staff, or implying an affiliation with gamedai that does not exist.
6. Illegal use: anything that breaks the law in your jurisdiction or in the United States.

We may block, rate-limit, or remove any user, IP, or signup that violates these rules, with or without notice.

If you encounter a bug or a problem on the site, the right response is to email hello@gamedai.app, not to escalate it through automated means.

Communications

By submitting the waitlist form, you agree to receive:

1. A confirmation email shortly after you sign up, acknowledging that we received your email address. This is part of the transaction you started, not a marketing communication.
2. Infrequent product updates. These cover launch announcements, beta invitations, important changes to the program, and similar events. We don't expect to send these often.

You can opt out of the second category at any time by:

1. Replying to any email we send with the word "remove" in the body, or
2. Emailing hello@gamedai.app with a request to be unsubscribed.

We commit to following the requirements of the US CAN-SPAM Act for the marketing-style emails: a clear sender identity, a meaningful subject line, a physical postal address (added once the entity has one), and a working opt-out path. Transactional emails (such as the signup confirmation) may still be sent after you opt out, because they are part of an action you took yourself.

If we ever introduce SMS, push notifications, or any other channel, separate consent will be collected for each channel.

Intellectual property

All content on this site — including marketing copy, page layouts, the gamedai name and brand, the audio samples, the visual design, the icons, and any code we wrote — belongs to the operator. Where third-party content appears (for example, an open-source library or a stock image), it is used under the license that applies to it.

You may:

1. View the site for personal, non-commercial purposes.
2. Share a link to the site, including on social media.
3. Quote a short, attributed excerpt of the public copy when discussing or reviewing the product.

You may not, without prior written permission:

1. Copy, modify, distribute, sell, or sublicense any of the content for commercial purposes.
2. Reproduce the audio samples in another product, podcast, video, or training dataset.
3. Use the gamedai name, logo, or trade dress in a way that suggests endorsement, sponsorship, or affiliation.
4. Strip attribution, copyright notices, or trademark notices from any content you copy under the limited permissions above.

If you submit a product suggestion through the suggestion form, you grant the operator a perpetual, worldwide, royalty-free license to use that suggestion to build, improve, and promote the product. You also confirm that the suggestion is your own and does not violate someone else's rights. The operator is under no obligation to use, credit, or compensate any specific suggestion.

The NFL, team names, team marks, and league marks referenced on the site belong to their respective owners. References on the site are factual (for example, identifying which team a user follows) and are not a claim of endorsement, sponsorship, or affiliation.

Disclaimers

This is a pre-launch product. The site previews something we intend to build. That means:

1. The site and any preview content are provided on an "as is" and "as available" basis. We make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
2. Any feature described on the site may change between now and launch. Features may be redesigned, renamed, postponed, scoped down, or removed entirely. Audio samples are illustrative; the production product's audio may differ in voice, length, format, and behavior.
3. Statements about future plans, timelines, partnerships, and roadmap are forward-looking. They are not commitments. The product may not ship at all.
4. The site may be down, slow, or contain errors. We do not promise any specific uptime or performance.
5. The audio samples are not real game commentary, are not affiliated with any broadcaster, and are not predictions of any actual game.

Nothing in this section is intended to disclaim any warranty or right that cannot be disclaimed under the laws that apply to you.

Limitation of liability

To the maximum extent permitted by applicable law, the operator and any future legal entity behind gamedai will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, or substitute services, arising out of or in connection with your use of the site, regardless of the legal theory and even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the site is limited to one hundred US dollars ($100), or the amount you have paid us in the prior twelve months, whichever is greater. Because no purchases are possible on this site today, the practical cap is one hundred US dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case those exclusions or limitations apply only to the extent permitted by law and the rest of this section continues to apply.

This section is written with the understanding that the operator is currently an individual and that no legal entity has yet been formed. Once an entity is in place, the limitation of liability will be aligned with that entity's structure, and this section will be updated.

Governing law

The governing law for these terms will be set when the legal entity behind gamedai is formed. Pending that decision, and unless mandatory local law requires otherwise, these terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Counsel will confirm or change this at incorporation.

This default selection does not deprive you of any consumer protection you would otherwise have under the mandatory law of your country of residence.

Dispute resolution

Most issues can be resolved with a quick email. The intended sequence is:

1. Informal resolution first. Before starting any formal process, write to hello@gamedai.app describing the issue, what you would like us to do, and how to reach you. We will respond within a reasonable time and try in good faith to work it out.
2. If informal resolution does not work within sixty (60) days of your first written notice, the formal process below applies.

Once the legal entity is formed and counsel has finalized this section, the formal process is intended to be:

1. Binding individual arbitration of any dispute arising out of or relating to these terms or the site. The arbitration will be administered by a recognized arbitration provider and will follow that provider's consumer rules, with the seat, language, and choice of arbitrator to be specified at that time.
2. No class actions, class arbitrations, or representative proceedings. Each dispute will be resolved on an individual basis.
3. An opt-out window during which you can decline arbitration by sending written notice to hello@gamedai.app. The length of this window will be set by counsel and is expected to be no shorter than thirty (30) days from your first acceptance of these terms or from the date the arbitration clause is finalized, whichever is later.
4. Carve-outs that allow either party to bring small-claims actions in their local court, and to seek injunctive relief in court for intellectual property disputes.

Until counsel has finalized the arbitration clause and posted the final version here, no party is required to arbitrate. Disputes that cannot be resolved informally during this interim period may be brought in a court of competent jurisdiction in the default governing-law jurisdiction stated above.

Nothing in this section prevents you from reporting an issue to a regulator, a data protection authority, or any other body whose role is to protect consumers.

Changes to these terms

We will update these terms from time to time. When we do, we will:

1. Update the "Effective" date at the top of this page.
2. Notify waitlist subscribers by email if a change is material — for example, a change to the dispute-resolution clause, the limitation of liability, or the rules around what you can and cannot do on the site.
3. Keep prior versions on request, at hello@gamedai.app, so you can see what has changed.

If you do not agree to a change, your option is to stop using the site and to email hello@gamedai.app to have your waitlist record removed. Continuing to use the site after a change is posted means you accept the updated terms.
